1. Acceptance

By creating an account or using the FLDMRK app ("the App"), you agree to these Terms. If you do not agree, do not use the App. You must be at least 13 years old, or the minimum age of digital consent in your country, to use FLDMRK.

2. What FLDMRK is

FLDMRK lets pilots collect a numbered digital card for an airport by traveling to that airport and checking in with GPS verification. The App also offers a collection, a pilot passport, friends, a leaderboard, and sharing. FLDMRK is a hobby and entertainment product. It is not an aviation navigation, flight planning, or safety tool, and must never be used in a way that distracts from safe operation of an aircraft. Do not interact with the App while flying or taxiing.

3. Your account

You are responsible for your account and for keeping your login secure. You agree to provide accurate information, such as a valid email, and not to impersonate others. You may not transfer or sell your account. One person per account.

4. Collecting and the registry

Collecting a card requires being physically at the eligible airport. Serial numbers and rewards are assigned by our servers and are final once issued. To keep the registry fair:

• You may not falsify, simulate, or spoof your location, tamper with the App, or use automated means to collect.
• We detect and reject simulated or implausible locations, and we may refuse, reverse, or revoke any claim, serial, score, badge, or other reward obtained in violation of these Terms or by error, bug, or abuse.
• Collecting is for your personal, non-commercial use. Digital cards, serials, ranks, and badges are a license to use within the App. They are not currency, securities, or property, have no cash value, and are not transferable or redeemable outside the App.
• We may change scoring, rarity, badges, and collection mechanics over time.

5. Subscriptions and purchases

FLDMRK may offer a paid "Pro" plan and other purchases through the Apple App Store.

• Payment is processed by Apple under Apple's terms. We do not receive or store your full payment card details.
• Auto-renewing subscriptions renew for the same period at the then-current price until you cancel. Manage or cancel in your App Store account settings. Cancel at least 24 hours before the period ends to avoid the next charge.
• A one-time, or "lifetime", purchase, if offered, grants the stated access for as long as the App and the applicable feature remain available.
• Refunds are handled by Apple under Apple's policies.
• Prices, plans, and what Pro includes may change. Changes do not affect a subscription period you have already paid for. The free tier of collecting is provided as is and may change.

6. Your content and sharing

You may create shareable images of your cards and stats. You keep ownership of photos you provide. You grant us a limited license to process your content within the App to render and export the shareable image on your device. You are responsible for content you share and for having the right to share any photo you use. Do not share unlawful, infringing, or harmful content.

7. Acceptable use

You agree not to: break the law; harass or harm others; reverse engineer, scrape, or disrupt the App or its servers; bypass anti-cheat or security; or use the App for any commercial purpose without our written permission. We may suspend or terminate accounts that violate these Terms.

8. Airport and aviation data

Airport information such as runways, elevations, frequencies, names, and imagery is provided for entertainment and may be inaccurate, incomplete, or out of date. Never rely on FLDMRK for any flight, navigation, or safety decision. Always use official, current aeronautical sources.

9. Availability, changes, and termination

We may change, suspend, or discontinue the App or any feature at any time. We may update these Terms; material changes will be posted with a new effective date and, where appropriate, notice in the App. Continued use after changes means you accept them. You may stop using the App and delete your account at any time. We may terminate or limit access for violations or to comply with law.

10. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error free, or secure, or that data, serials, or rewards will be preserved.

11. Limitation of liability

To the maximum extent permitted by law, FLDMRK and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, collection, profits, or goodwill. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US$50. Some jurisdictions do not allow these limits, so they may not fully apply to you.

12. Indemnity

You agree to indemnify and hold harmless FLDMRK and its owners from claims arising out of your use of the App, your content, or your violation of these Terms, to the extent permitted by law.

13. Governing law and disputes

These Terms are governed by the laws of [STATE / COUNTRY], without regard to conflict of law rules.

14. Apple

These Terms are between you and FLDMRK, not Apple. Apple is not responsible for the App or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you. Apple has no obligation to provide support or handle claims relating to the App.
